Distance Sales Agreement

This Distance Sales Agreement is concluded electronically between the Service Provider identified below and the Buyer for a Zer Bazaar subscription, pursuant to Turkish Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts.
Article 1 — Parties (Service Provider)

Article 2 — Subject
The subject of this agreement is to set out the rights and obligations of the parties regarding the provision of the Zer Bazaar software subscription service ordered electronically by the Buyer, whose features and price are stated below.
Article 3 — Service and Price
Service: Zer Bazaar — cloud-based business management software (subscription) for jewelry businesses.
Price: the monthly subscription fee shown on the order/payment screen for the plan you select (VAT included). The subscription renews automatically each month.
Payment method: credit/debit card. Payment is processed by a licensed payment institution; card details are not stored by the Service Provider.
Article 4 — Delivery / Performance
The service is digital; upon payment confirmation the Buyer’s account is activated immediately and the service is accessed at https://app.zerbazaar.com. There is no physical delivery.
Article 5 — Right of Withdrawal
Even if performance has begun, under the money-back guarantee offered by the Service Provider the Buyer may cancel the subscription within 14 (fourteen) days of the first payment date and request a full refund of the amount paid. Refunds are made via the same payment method.
Although, under Article 15 of the Regulation on Distance Contracts, there is generally no right of withdrawal for digital services performed instantly, the Service Provider offers an unconditional refund guarantee throughout the period stated above.
Article 6 — General Provisions
The Buyer acknowledges having read and understood the preliminary information regarding the essential features of the service, the sale price, the payment method and performance, and having given the necessary confirmation electronically.
In disputes that may arise between the parties, the Consumer Arbitration Committees are competent up to the value announced by the Ministry of Trade, and above that, the Consumer Courts at the Buyer’s place of residence.
